When you’re happy with the drafts, simply come in, sign them and leave with copies of your estate plan in hand. And complete peace of mind.

A detailed Medicaid eligibility plan will be prepared outlining the options and strategies available to you to meet your goals.

Medicaid Implementation Plan Review


If you decide to implement your personalized Medicaid eligibility plan, TuckerAllen will work closely with you to secure all the documentation required, prepare and file the application, and work with the Medicaid office to assure your application is successful. This implementation of your plan is customized and the cost varies based on your needs and financial situation.

Couples: $4,500-$9,500

VA Benefits

VA Planning & Strategy


This “goal-setting” meeting includes a comprehensive review of your financials, medical needs, existing estate plan (if applicable) and family needs to qualify for the Aid & Attendance Pension through the Veterans Benefits Administration. This typically includes a Veterans Asset Protection Trust that allows clients to place assets into a trust while still qualifying for VA benefits.

The Initial Consultation Fee will be applied to future services.

VA Implementation Plan Review


Implementation includes review of assets, review of income, and the drafting and funding of the Veterans Asset Protection Trust and VA annuity, if needed. TuckerAllen then works closely with VA-Accredited Partners during application to various Veterans Service Organizations. (In accordance with VA regulations, a Veteran can never be charged for a third party to assist with the completion of a VA Aid & Attendance application. Our fees reflect this policy.)

Special Needs Planning

Special Needs Estate Plan Package


If you are a family member, friend, or guardian of an individual with special needs, you may wish to choose the Special Needs Estate Plan Package instead of a traditional will or trust. This plan offers the additional advantage of allowing you to set aside funds for an individual with special needs without disqualifying them from receiving eligible public benefits. Includes: Advanced Planning Revocable Trust, Pour-Over Will, Healthcare Directive (Living Will), Medical Power of Attorney, HIPAA Release, Financial Power of Attorney and Beneficiary Deed.

Third-Party Supplemental Needs Trust


Unlike the Special Needs Estate Plan Package, a Third-Party Supplemental Needs Trust is not an estate plan. Instead, it is a trust set up specifically to benefit an individual with special needs by a third party (often a friend or family member). It is structured to make assets available to the special needs individual without rendering them ineligible for public benefit programs such as Medicaid and supplemental security income (SSI).

First-Party Special Needs Trust

Also known as a d4a Trust or Payback Trust, these documents are extremely important in assisting people with disabilities who receive money and cannot lose their government benefits. Without such a trust, the person with the disability would lose crucial benefits such as Medicaid, Social Security, or other government benefits that they depend upon for medical care, income, or housing needs. We are familiar with these trusts and assist clients in various situations where the client has received money from a personal injury settlement, inheritance, or newly discovered asset.

Probate and Trust Administration


If a loved one has passed and you’ve been designated as the trustee or executor of an estate, TuckerAllen can help guide you through the process or assume many of the responsibilities. Fees vary according to the scope of the estate.

Guardianship & Conservatorship


When a minor or adult has been legally determined to be incapacitated or disabled, the court appoints a guardian (responsible for care and custody) and a conservator (responsible for managing property – could be a person or a corporation, such as a bank or trust company). Often the same individual is appointed for both. TuckerAllen can arrange for a capacity assessment of the disabled individual and help you petition the court to be appointed as guardian and/or conservator.

  • The annual percentage rate is 0%.
  • A 25% down payment is due upon your signing an engagement letter with us.
  • The remaining balance is due in equal monthly installments over 12 months.
  • The first monthly installment is due the first full calendar month after your documents are signed.
  • Each monthly payment will be automatically charged to your credit card on or about the 15th of each calendar month.
  • There is no prepayment penalty.
  • There are no finance charges or other fees applied to the balance.
