VA Benefits

Veterans are entitled to important government benefits through the U.S. Department of Veterans Affairs (VA). If you or your spouse requires long-term care, you may be entitled to additional monthly benefits – above and beyond your military pension – to cover these costs. We can help you determine your eligibility and secure the benefits you deserve.

A Unique Monthly Benefit That Often Goes Unused

The Aid & Attendance (A&A) and Housebound program is a unique benefit administered by the VA for veterans and their surviving spouses. It’s designed to help veterans and their families with the increasingly exorbitant costs of in-home or institutional care. Sadly, those who need it most are often never informed of its existence.

You may be entitled to A&A benefits if you are a veteran or surviving spouse of a veteran, and:

  • You are housebound
  • You require a caregiver to assist you with tasks that are vital for daily functioning
  • You are bedridden
  • You are a nursing home patient
  • You have severely limited vision

Depending on your situation, you may be able to obtain upward of $1,000 per month in additional benefits.

Overcoming the Barrier to Eligibility for Additional Benefits

An experienced TuckerAllen elder law attorney can help you explore your eligibility for the A&A program and other forms of VA benefits. We can show you strategies that could allow you to qualify for this underused benefit.

Veterans Asset Protection Trust

These widely popular irrevocable trusts are used by veterans or their spouses to qualify for the A&A program. A Veterans Asset Protection Trust provides a way to redistribute assets that could otherwise prove to be barriers to eligibility. There is currently no penalty for the funding of these trusts, but that is soon to change. Therefore, we strongly recommend that you review this option immediately if you are interested in VA benefits.

VA Planning & Strategy

This “goal-setting” meeting includes a comprehensive review of your financials, medical needs, existing estate plan (if applicable) and family needs to qualify for the Aid & Attendance Pension through the Veterans Benefits Administration. This typically includes a Veterans Asset Protection Trust that allows clients to place assets into a trust while still qualifying for VA benefits.

$500 Initial Consultation

Individuals: $1,500
Couples: $2,500

The Initial Consultation Fee will be applied to future services.

VA Implementation Plan Review

Implementation includes review of assets, review of income, and the drafting and funding of the Veterans Asset Protection Trust and VA annuity, if needed. TuckerAllen then works closely with VA-Accredited Partners during application to various Veterans Service Organizations. (In accordance with VA regulations, a Veteran can never be charged for a third party to assist with the completion of a VA Aid & Attendance application. Our fees reflect this policy.)

Varies case-by-case.

Fixed fees will be known at the end of the implementation meeting.

Christine was very easy to deal with and helped us understand what was going on. She was also very, very nice to my dad. She took time to go over information one or 1,000 times. She didn’t make him feel stupid. He wanted to know the in’s and out’s of things and she took the time. We thank her for that!
