Non-Resident Alien

An individual who is neither a resident nor a citizen of the United States. A non-resident alien’s property in the United States may nonetheless be subject to federal estate tax and/or probate. An estate tax treaty between the alien’s home country and the United States may affect whether the alien’s estate is subject to U.S. taxes or probate laws.
